JAIPUR: Just the fear of losing control over one’s company due to the Insolvency & Bankruptcy Code (IBC) has helped creditors, banks and others such as suppliers recover dues from these entities as promoters and management paid up soon after cases were filed in the National Company Law Tribunal (NCLT), without waiting for the petitions to be admitted.
At 25,565, the number of cases closed before admission in NCLT benches is 3.7 times higher than the number of cases that are admitted (6,811), which results in the appointment of a resolution professional and committee of creditors, and ouster of promoters.
