The Bill amends the Migration Act 1958 (Cth) (the Act) and the Migration Regulations 1994 (Cth) to introduce a new regime for Subclass 070 (Bridging (Removal Pending)) visas (BVR).
Who does the Bill apply to?
The Bill is primarily directed to persons who were granted a BVR since 8 November 2023, including the cohort affected by the High Courts orders in NZYQ v Minister for Immigration, Citizenship and Multicultural Affairs. For that group, their current BVR will automatically cease and a new BVR will come into effect under the new regime in the Bill.[1] That new regime will also apply to any person who is granted a BVR after the legislation comes into effect.[2]
